border_style_all=&#8221;solid&#8221; border_color_bottom=&#8221;#0c71c3&#8243; use_border_color=&#8221;on&#8221; border_color=&#8221;#f7f7f7&#8243; border_style=&#8221;solid&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>The Drug-Free Schools and Communities Act Amendments of 1989 requires that institutions of higher education certify that they have adopted and implemented a drug and alcohol prevention program to PREVENT the unlawful possession, use, or distribution of illicit drugs and alcohol by students and employees.<\/p>\n<p>South Baylo University is committed to a harmonious learning environment free of prohibited or controlled substances.\u00a0 This policy aims to promote health, safety, and general wellbeing for all members of the University community which includes administration, faculty, staff, students, and guests.<\/p>\n<p>Therefore, all members of the South Baylo University community must abstain from the possession or consumption of alcohol, narcotics, and\/or misuse of prescription drugs while on University property or on any field trip sponsored as part of the instructional program.<\/p>\n<p><u><strong>Drug and Alcohol Abuse Prevention<\/strong><\/u><br \/> South Baylo University promotes prevention by continuously posting updated information on awareness, prevention, and health risks of drug and alcohol abuse.<\/p>\n<p><u><strong>Drug and Alcohol Abuse Health Risk<\/strong><\/u><br \/> South Baylo University is committed to informing <span>its <\/span><span>students, faculty and staff members<\/span> of the harmful effects of drug and alcohol abuse.\u00a0Well known health risk includes the depressed immune system, hangover, liver disease, alcohol poisoning, memory loss, birth defects, and even death.<br \/> There are many long-term health risks including heart, respiratory and circulation problems as well as mental problems such as depression, psychosis, cognitive problems, and violent behaviors.<br \/> Drug and alcohol abuse can result in reduced levels of attendance, impaired work performance and increased risk to the health and safety of the individual as well as to others.<\/p>\n<p><u><strong>Sanctions for Violation of the Drug and Alcohol Abuse Policy<\/strong><\/u><br \/> Violation of the Drug and Alcohol Abuse Policy may lead to suspension, expulsion, termination, and in the context of criminal activity, referral to law enforcement agencies.<\/p>\n<p><u><strong>Drug and Alcohol Advisement<\/strong><\/u><br \/> Employees and students having difficulties with addictive substances can seek confidential advice from the Director of Operations or the Student and Alumni Services Coordinator for referrals to agencies providing assistance with alcohol or drug abuse problems.\u00a0 The South Baylo University Clinic also provides alternative assistance treatment through acupuncture and herbs.<br \/> The Student and Alumni Services Coordinator can be reached by phone 714-533-1495 or email\u00a0<a href=\"mailto:studentservices@southbaylo.edu\">studentservices@southbaylo.edu<\/a>.<\/p>\n<p><u><strong>Review of Drug and Alcohol Abuse Prevention Policy<\/strong><\/u><br \/> The South Baylo Drug and Alcohol Abuse Prevention Policy will be reviewed biennially to determine its effectiveness. The Policy will be updated, if needed, to meet the needs of the South Baylo University community.<\/p>\n<hr \/>\n<p><a name=\"drug\"><\/a><\/p>\n<p><u><strong>Drug Convictions and Financial Aid Eligibility<\/strong><\/u><\/p>\n<p>Under the Higher Education Act, a student may become ineligible for federal student aid upon conviction of any offense involving the possession or sale of illegal drugs while receiving Title IV federal financial aid. Federal aid includes Federal Direct Loans, Federal PLUS Loans, Federal Graduate PLUS Loans, Federal Pell Grants, Federal Supplemental Educational Opportunity Grants, Federal ACG Grants, Federal SMART Grants, Federal TEACH Grants, Federal Work-Study, and Perkins Loans.<\/p>\n<p><u>Penalties for Drug Law Violations<\/u><\/p>\n<p>A federal or state drug conviction can disqualify a student to receive Federal Student Aid.<br \/> Convictions only count if they were for an offense that occurred during a period of enrollment for which the student was receiving Title IV aid &#8211; they do not count if the offense was not during such a period. Also, a conviction that was reversed, set aside or removed from the student&#8217;s record does not count, nor does one received when the student was a juvenile unless the student was tried as an adult.<\/p>\n<p><u>Possession of Sale of Illegal Drugs<\/u><\/p>\n<p>If you have been convicted of drug possession or the sale of illegal drugs, please notify the Financial Aid Officer\u00a0to help determine your eligibility for student aid.<br \/> A student regains eligibility the day after the period of ineligibility ends or when the student successfully completes a qualified drug rehabilitation program. Further drug convictions will make the student ineligible again. It is the student&#8217;s responsibility to certify to their financial aid office that a qualified drug rehabilitation program has been successfully completed.<br \/> When a student regains eligibility during the award year, the school may award Campus-based aid for the current payment period and Direct loans for the period of enrollment.<br \/> A qualified drug rehabilitation program must include at least two unannounced drug tests and must satisfy at least one of the following requirements:<\/p>\n<ul type=\"disc\">\n<li>Be qualified to receive funds directly or indirectly from a federal, state or local government program.<\/li>\n<li>Be qualified to receive payment directly or indirectly from a federally or state-licensed insurance company.<\/li>\n<li>Be administered or recognized by a federal, state or local government agency or court.<\/li>\n<li>Be administered or recognized by a federally or state-licensed hospital, health clinic, or medical doctor.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.southbaylo.edu\/web\/data\/2018_DAAPP_Biennial_Review.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">DAAPP (Drug and Alcohol Abuse Prevention Program)\u00a0Biennial Review<\/a><span>\u00a0<\/span><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.southbaylo.edu\/ca\/images\/pdf.gif\" alt=\"\" width=\"30\" height=\"16\" align=\"absmiddle\" \/><\/p>\n<p>[\/et_pb_toggle][et_pb_toggle title=&#8221; border_style_all=&#8221;solid&#8221; border_color_bottom=&#8221;#0c71c3&#8243; use_border_color=&#8221;on&#8221; border_color=&#8221;#f7f7f7&#8243; border_style=&#8221;solid&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>South Baylo University (SBU) is committed to operating in full compliance with all applicable laws, rules and regulations, governing business practices, record keeping, including those concerning accounting and auditing, and prohibits fraudulent practices by any of its board members, officers, employees, or volunteers.<\/p>\n<p>This policy outlines a procedure for employees to recognize and report actions that the employee reasonably believes are in violation of law or regulation or that constitutes fraudulent accounting or illegal activity. \u00a0This policy applies to any matter which is related to SBU\u2019s business practices and does not relate to individual activities conducted outside of the employment relationship.<\/p>\n<p><b>Whistleblower<\/b><\/p>\n<p>A \u201cwhistleblower\u201d is an employee who discloses information to a government or law enforcement agency, person with authority over the employee, or to another employee with authority to investigate, discover, or correct the violation or noncompliance, or who provides information to or testifies before a public body conducting an investigation, hearing or inquiry, where the employee has reasonable cause to believe that the information discloses:<\/p>\n<ol type=\"1\">\n<li>A violation of a state or federal statute,<\/li>\n<li>A violation or noncompliance with a local, state or federal rule or regulation, or<\/li>\n<li>With reference to employee safety or health, unsafe working conditions or work practices in the employee\u2019s employment or place of employment.<\/li>\n<\/ol>\n<p>A whistleblower can also be an employee who refuses to participate in an activity that would result in a violation of a state or federal statute, or a violation of or noncompliance with a local, state or federal rule or regulation.<\/p>\n<p>&nbsp;<\/p>\n<p><b>Procedure<\/b><\/p>\n<p>If an employee has a reasonable belief that SBU, through its directors, officers, staff, or faculty, has engaged in any action that violates any applicable law, or regulation, including those concerning accounting and auditing, or constitutes a fraudulent practice, the employee is expected to immediately report such information, in writing, to the President. \u00a0If the employee does not feel comfortable reporting the information to the President, he or she is expected to report the information to the Director of Operations.<\/p>\n<p>All reports will be investigated immediately in strict accordance with the Whistleblowers Protection Act. \u00a0In conducting its investigations, SBU will strive to keep the identity of the whistleblower as confidential as possible, while conducting a thorough review and investigation.<\/p>\n<p>Any person or persons found to be in violation of any applicable laws, rules, and regulations, governing business practices, record keeping, including those concerning accounting and auditing, or fraud, shall be disciplined according to the university\u2019s disciplinary policy, up to and including termination.<\/p>\n<p>&nbsp;<\/p>\n<p><b>Non-Retaliation<\/b><\/p>\n<p>SBU will not retaliate against an employee in the terms and conditions of employment because that employee:<\/p>\n<ol type=\"a\">\n<li>reported a reasonable belief of legal violation to a supervisor, the President, the Board of Directors or to a federal, state or local agency; We celebrate it every year on <strong>September 17<\/strong> because that&#8217;s the date in 1787 when the founders signed the Constitution.<\/p>\n<p>This holiday was created in 2004 when Senator Robert Byrd added it to a government spending bill. Before 2004, it was just called &#8220;Citizenship Day.&#8221; The new law states that all schools receiving government funding must teach students about the history of the Constitution on this day.<\/p>\n<p>If September 17 falls on a weekend or another holiday, schools celebrate it on a nearby weekday instead.
